Seller will cover the cost of bringing the Septic System on the property into compliance with Title 5 Regulations, Board of Health Regulations and/or any Order issued by the Town of West Tisbury for the Property in its current state. In order to accomplish this Seller and Buyer shall enter into a mutually acceptable and reasonable escrow agreement at closing, which shall require, among other things, that : (1) a portion of the proceeds due to Seller equal to 150% of the estimated cost of the title 5 work (as determined by a written estimate obtained by Seller) be held in escrow by Buyer’s attorney, pending completion of the Title 5 work; (2) the excess escrowed funds shall be returned to Seller promptly. If there is any disagreement regarding return of the escrowed funds then a neutral inspector shall be appointed and agreed upon by both the Buyer and Seller and escrowed funds shall be returned returned to seller one day after the inspector determines that the Title 5 work has been completed. Note, this is to bring the property into compliance with TItle V. Any additional treatments desired by the buyer will be at the buyer's expense.
